Sulloway Assists Medical Providers in Suit over $110 Million Medical Malpractice Insurance Fund.

 
February 2010 - Concord, NH: Members of Sulloway's Government Relations Practice Group, Martin Gross, Martin Honigberg, and Amy Manzelli, represented the New Hampshire Medical Society (NHMS) and the American Medical Association (AMA) in the successful challenge to legislation allowing the State to take $110 million from a medical malpractice insurance fund , known as the JUA. Starting last year, when the idea first arose publicly of using the JUA’s surplus for the State’s general budgetary purposes, Sulloway began working to protect the funds. Sulloway identified the significant constitutional problems presented by the legislation and urged policy makers to consider alternatives. Sulloway ultimately set forth its legal arguments before the New Hampshire Supreme Court in a brief submitted for the NHMS and the AMA. The Supreme Court adopted the bulk of Sulloway's analysis, ruling that the State's appropriation was unconstitutional. The funds will now remain within the control of the JUA and may not be used by the State.
