Ed Kaplan and Jay Surdukowski Prevail at New Hampshire Supreme Court

The New Hampshire Supreme Court in an order has upheld the dismissal of a lawsuit against a Massachusetts town and three of its police officers.  The Court affirmed the trial court’s conclusion that claims for civil rights violations and other alleged tortious actions that occurred in Massachusetts among Massachusetts actors were not properly before the New Hampshire Superior Court.

The Plaintiff had previously litigated the issue of personal jurisdiction and lost in the United States District Court for the District of New Hampshire.  In the ensuing state court case, the trial court found personal jurisdiction to have been already decided in the federal decision that the Plaintiff did not appeal and therefore the trial court applied collateral estoppel to bar the claims from being litigated all over again.
