The attorneys in our group represent many insurance companies, health maintenance organizations, agents and brokers, employee benefit plans, third-party administrators, and a national insurance trade association in a wide variety of matters. In particular, we have broad and extensive experience in the following areas:

• Insurance corporate and regulatory matters, including: formation, organization, qualification, domestication, licensing, registration, rehabilitation, mergers and acquisitions, and reorganizations;
• Representation of insurance companies and associations before the New Hampshire legislature, the New Hampshire Insurance Department and other state agencies, advising our clients about significant legal decisions and legislative and regulatory changes at both the state and federal level, and filing amicus curiae briefs with the New Hampshire Supreme Court on matters of interest to the industry;
• Litigation related to individual and group insurance policies of all kinds including: general, commercial, and professional liability, property, homeowners, life, accident, health, disability, long-term care, directors and officers, motor vehicle, aviation, marine, excess, reinsurance, and title insurance policies, among others, and involving state law (including bad faith, unfair trade practices, misrepresentation and rescission issues) and federal law (including ERISA matters) before state agencies and state and federal trial and appellate courts;
• Managed care, professional liability and fiduciary breach litigation involving HMOs, insurance agents and brokers, and third-party administrators, among others;
• Insurance coverage matters, including: coverage advice and analysis and defense of declaratory judgment and related litigation;
• Construction surety, fidelity and probate bond claims.

Our Strength

Our team consists of experienced insurance lawyers who are leaders in their respective fields, including the former president of a mutual life insurance company listed in Who’s Who in Insurance and Best Lawyers in America who was recently selected by the New Hampshire Insurance Commissioner and a board of senior insurance industry executives to guide New Hampshire in forming a health insurance high-risk pool; a member of the national “select list” of lawyers for life, health and disability insurance companies and the life, health and disability section of the DRI, who represents several major insurance companies in benefits-related litigation and who is a frequent author and speaker on insurance benefit matters; as well as several other lawyers with substantial experience representing insurance companies in the legislative, regulatory, litigation, and coverage areas.
