Michel
A. LaFond focuses his practice on corporate
finance, general business
and regulatory matters, substantially in the health
care industry.
He is counsel to physicians, hospitals, and other healthcare providers,
healthcare service companies and medical device companies. He has
counseled on general corporate and contract matters, private and
public debt and equity offerings, mergers and acquisitions, Medicare/Medicaid
fraud and abuse, Stark physician anti-referral legislation and other
federal and state healthcare regulations that apply to such providers,
service companies and medical device companies. Mr. LaFond previously was the Leader of Sulloway’s Healthcare Group and previously was an elected member of the Executive Committee.
He has counseled hospitals on the structure and financing of facilities,
the structure and implementation of joint ventures of hospitals
and physicians, the organization of physician-hospital organizations,
the negotiation and preparation of health plan provider contracts
and other matters. He has networked and reorganized a number of
medical practice groups, and integrated medical group networks
and
counseled physicians and medical practice groups on the structure
and financing of freestanding outpatient diagnostic and treatment
facilities, physician/hospital organizations, management services
organizations, physician practice management companies and
integrated
delivery systems, provider contracts with health plans and other
matters. In addition, he has represented preferred provider
organizations
and health maintenance organizations and has participated in the
start-up and licensing of a number of new health maintenance
organizations.
Mr. LaFond has authored a number of articles and made a number
of presentations, locally and nationally, regarding integrated
delivery
systems and the attendant antitrust, physician anti-referral and
fraud and abuse issues. He has co-authored with John F. McCally, Physician Practice Management Redefined: The Move to
Integrated Practice Organizations, published by McGraw-Hill,
in 1998.
He is a graduate of Yale University and received his J.D. degree
from American University Law School in 1970. From 1970-1972 he was
a law clerk to Associate Justice Harry A. Blackmun at the Supreme
Court of the United States. He is a Fellow, past member of the Board of
Directors and past Chair of the Physician Organization Substantive
Law Committee of the American Health Lawyers Association.
Mr. LaFond is admitted to practice law in Minnesota,
New Hampshire, Maine, Massachusetts, Nebraska, Iowa and Texas.
