David W. Johnston joined Sulloway & Hollis in 2015 as a Member.  He has over 25 years of civil litigation experience trying cases before juries and judges in state and federal courts. Dave also has extensive appellate experience, having briefed and argued numerous cases before the New Hampshire Supreme Court. He represents both individuals and institutional clients in matters involving insurance defense and coverage, personal injuries, products liability claims, construction defects, timber trespass and property disputes, landlord and tenant litigation, and claims made under the Federal Employers Liability Act (FELA).

In recognition of his skills, Dave has repeatedly achieved an “AV Preeminent” rating for Legal Abilities and Ethical Standards from Martindale-Hubbell, the highest overall rating attainable from the legal profession’s foremost independent legal review organization. Dave has also been selected by his peers for inclusion as a Best Lawyers in America© since 2018.  He is a member of the Defense Research Institute, a member of the Tri-State Defense Lawyers Association, and a member of the National Association of Railroad Trial Counsel.

Dave has practiced law in New Hampshire since graduating from Boston College Law School, cum laude, in 1992, and in Massachusetts since 2001. Prior to becoming a lawyer, he served as a Surface Warfare Officer in the United States Navy.

 

REPRESENTATIVE CASES:

  • Successfully defended large international transport company in a jury trial and through appeal involving claims of catastrophic personal injuries
  • Obtained defendant’s verdict in highly contentious assault and negligence action against towing company in federal court
  • Obtained summary judgment which was affirmed on appeal for large condominium association sued by marina claiming significant damages allegedly due to client’s surface water drainage system
  • Negotiated substantial monetary settlements for victims of automobile accidents, dog attacks, employment discrimination, and falls on improperly maintained properties
