Attorney Derek Lick Prevails Before the NH Supreme Court

Sulloway attorney Derek Lick recently prevailed before the New Hampshire Supreme Court in securing dismissal of claims against his client, a large commercial property developer.  Had the opposing party prevailed, Derek’s client would have been precluded from undertaking a significant expansion of its retail complex that included the construction of a large grocery store that has been sought for years in the community served by the client.  The opposing party, an owner of land adjacent to his client’s retail complex, attempted to stop the client’s expansion by filing suit and claiming that it retained an access easement over a discontinued road that had to be razed for the expansion.  Derek initially obtained dismissal of the claims against his client in the trial court.  The opposing party appealed.  Derek’s client prevailed on appeal, with Derek having briefed and argued the case before the New Hampshire Supreme Court.  See NH SCT Order 100821
