Attorneys Margaret Nelson and Derek Lick Successfully Obtain and Defend $7.3 Million Award in Dispute Over Value of Power Plant and Other Assets
The Sulloway team of Attorney Margaret Nelson and Attorney Derek Lick successfully defended before the New Hampshire Supreme Court a favorable trial court ruling awarding Sulloway’s client, Eversource, a judgment in excess of $7.3 million in a property tax appeal.
The dispute centered on the value of the Merrimack Station power plant and the transmission and distribution assets in Bow, New Hampshire for the 2012 and 2013 tax years. After a six day trial, the Merrimack County Superior Court ruled in favor of Eversource and concluded that the Town’s assessments of both the plant and the transmission and distribution system were excessive and disproportional.
The Town appealed to the New Hampshire Supreme Court, and after briefing by Meg and Derek and oral argument by Meg, the Supreme Court upheld the trial court decision.
