Sulloway Prevails for Client at the New Hampshire Supreme Court
Sulloway attorneys Derek Lick and Iryna Dore prevailed before the New Hampshire Supreme Court on behalf of the firm’s long-time client, the Settlers’ Green outlet stores in Conway, New Hampshire. At issue in the Supreme Court appeal was whether Settlers’ Green could expand its development and construct, among other things, a much-awaited Market Basket grocery store.
Mr. Lick joined Settlers’ engineer in presenting its application for the construction to the Town’s Planning Board. The Planning Board approved the application after multiple meetings and over the objection of an abutter, the North Conway Grand Hotel. The Hotel appealed the Town’s approval to the Carroll County Superior Court, where Mr. Lick intervened and joined the Town’s counsel in defending the project and the Town’s approval at trial and in post-hearing pleadings. The Superior Court affirmed the approval of the project, allowing it to proceed.
The Hotel appealed again, this time to the New Hampshire Supreme Court. Attorney Lick, with the assistance of Attorney Iryna Dore, prepared the lead brief filed with the Court to which the Town joined. The Supreme Court ultimately ruled in favor of Settlers’ Green, and concluded that the development met the Town’s requirements and that the Planning Board acted appropriately in approving the project.
